If I remember the circumstances, this girl did not want to go through with the pregnancy -- her right to choose was abrogated by her mother (hey, there's that parental notification thing in action, yay team!) -- but was compelled to. At four months, she persuaded her boyfriend, who also did not want to go through with the pregnancy, to do something stupid and desperate.
It was also legal -- for her.
How, please, if it was legal, for her, can it possibly be a capital crime for him?
